TERMS AND CONDITIONS

Seller - MB "Per aspera ad astra", company code 303156833, address: Labdarių g. 4-13, LT-01120, Vilnius, whose goods and services are sold on the website www.testas.lt, and who is responsible for executing the order placed by the Buyer.

1.2. the Buyer is a natural person with legal capacity (i.e. a person who has reached the age of majority and whose legal capacity has not been restricted by a court order) or a legal entity purchasing goods and services on the website www.testas.lt

1.3 Parties - the Buyer and the Seller together.

1.4. the Terms and Conditions - these "Terms and Conditions of Sale and Purchase" shall apply to each purchase made by the Buyer on the www.testas.lt website and to the Sale and Purchase Agreement concluded between the Parties.

1.5 Account - the result of the Customer's registration on the www.testas.lt website, which results in creating a personal account of the Customer that stores his/her personal data and order history. The account may be created based on the Buyer's mobile phone number or e-mail address. 

1.6. "Website" means the website www.testas.lt

1.7 Contract - a contract of sale concluded between the Buyer and the Seller, which shall be deemed to have been concluded from the moment of order confirmation, i.e. payment of the order.

 1.8. Shipment Code - a single-use shipment code generated by a third party, AB Lietuvos Pasts, using which the Buyer may send one shipment of a fixed size to the Seller. One Consignment Code is generated per consignment. 

GENERAL PROVISIONS

2.1 Before placing an order, the Buyer must tick a box and confirm that he/she has read and accepted the Terms and Conditions of the Sale and Purchase. The Terms and Conditions, thus approved, shall constitute a binding legal document for the Parties, setting out the rights and obligations of the Buyer and the Seller, the conditions for the purchase of the goods or services and the payment for them, the refund procedure, the liability of the Parties, and any other terms and conditions relating to the purchase-sale on the website www.testas.lt.

2.2 In the course of the purchase, it is not possible for the Buyer to agree and undertake to comply with the Terms and Conditions with certain exceptions. Should the Buyer have any comments or wish to proceed in a manner different from that set out in the Terms and Conditions, it is obligatory to obtain the prior written consent of the Seller or to await the amendment or supplementation of these Terms and Conditions accordingly.

2.3 The Seller shall have the right to amend, modify, or supplement the Terms. The amended Terms and Conditions shall be published on the Website. All amendments to the Terms and Conditions shall come into force from the moment of their publication unless a later effective date for amendments to the Terms and Conditions is expressly and unambiguously stated.

2.4 The Buyer must familiarize himself with the Seller's Privacy Policy published on the website www.testas.lt. The processing of the Buyer's data shall be carried out by the applicable legislation and the Privacy Policy published on the website.

2.5 If the Seller has the right or obligation to provide the Buyer with information or documents by e-mail, the Buyer shall be responsible for providing the Seller with a valid e-mail address that belongs to the Buyer.

MOMENT OF CREATION OF THE LEGAL RELATIONSHIP OF SALE AND PURCHASE

3.1 When ordering services on the website www.testas.lt, the Buyer must indicate in the information fields provided in the system the personal data necessary for the proper execution of the order of goods and services, which are processed by the Seller by the procedure provided for in the Privacy Policy.

3.2 When the Buyer, having selected the service to be purchased, completes all the steps of the order and submits the order, it shall be deemed that a legal relationship of sale and purchase has been established and a contract of sale and purchase has been concluded between the Seller and the Buyer. The Buyer shall be informed of the confirmation of payment using a message in the web browser.

3.3 Each Buyer's order shall be stored in the Seller's database by the procedures set out in the Privacy Policy.

RIGHTS AND OBLIGATIONS OF THE BUYER

4.1 The Buyer shall have the right to purchase goods and services on the www.testas.lt website by the Terms and Conditions.

4.2 The Buyer shall have the right to cancel the order and terminate the Contract by the procedure set out in the Terms and Conditions.

4.3 The Buyer, when using the Website, is obliged to fulfill his/her obligations, to comply with these Rules, and the Privacy Policy, and not to violate the legislation of the Republic of Lithuania.

RIGHTS AND OBLIGATIONS OF THE SELLER

5.1 The Seller undertakes to execute the Buyer's orders by the procedures set out in these Terms and Conditions, by these Terms and Conditions, and the Privacy Policy.

5.2 The Seller undertakes to respect the Buyer's privacy and to process the Buyer's data only by the procedures set out in these Terms and Conditions, the Privacy Policy, and the legal acts of the Republic of Lithuania and the European Union.

5.3 The Seller undertakes to comply with other obligations imposed on the Seller by the Terms and Conditions and the legislation of the Republic of Lithuania.

PAYMENT ARRANGEMENTS

6.1 The prices of goods and services on www.testas.lt shall be quoted in Euro, including the then applicable VAT rate by the law and other taxes, if any. 

6.2 The Buyer may pay for the ordered goods and services by bank card or electronic banking.

6.3 The order is confirmed when the Seller receives payment for the goods or services.

6.4 The Buyer must contact the Seller by email at info@testas.lt to receive an invoice.

6.5 If the Buyer so requests, an invoice may be issued to a company or other body other than the Buyer. Such invoice shall be issued and sent to the Buyer at the email address provided by the Buyer.

DELIVERY OF GOODS/SERVICES

7.1 The Shipment Code purchased by the Buyer shall be made available by text message to the mobile phone number indicated on the Buyer's website immediately after the Seller receives payment for the service.

7.2 The instructions for the use of the Shipment Code shall be sent to the Buyer via a message in the web browser immediately after payment.

PROCEDURE FOR TERMINATION OF THE CONTRACT OF SALE AND REFUND.

8.1 The return of goods shall be subject to the procedures provided for in the legislation of the Republic of Lithuania.

8.2 If the Buyer starts the order and does not complete it (without payment), the purchase transaction shall be deemed to have failed.

8.3 If the Website offers a money-back guarantee to the Buyers, the Buyer may make use of the money-back guarantee within a specified period from the date on which he/she makes the order/payment. In this case, the Buyer shall be refunded the full amount paid and the concluded Purchase and Sale Agreement shall be terminated.

8.4 Refunds may be made within 14 days only if the Buyer proves that the shipping code purchased is not valid and the Buyer was unable to use the code to send the parcel. 

8.5 In all other cases, no refunds will be given unless agreed between the Buyer and the Seller.

LIABILITY

9.1 The Buyer shall be liable for any unauthorized acts committed through the use of the www.testas.lt website. 

9.2 In the event of a breach of the Terms and Conditions, the Buyer's access to the www.testas.lt website may be suspended indefinitely. 

9.3 Once registered, the Buyer is responsible for the protection and/or transfer to third parties of his/her login data (login name, password).

9.4 The Seller shall be exempt from any liability in cases where the loss is caused by the Buyer's failure to read these Terms and Conditions and the Privacy Policy, notwithstanding the Seller's recommendations and obligations, even though the Buyer was allowed to do so.

FINAL PROVISIONS

10.1 All communications relating to the purchase of goods and services shall be made through the contacts indicated on the Website. If the Buyer communicates about the goods or services by other means, the Seller shall not accept any liability or risk that may arise from such communication. 

10.2 All disputes arising from the performance of these Terms and Conditions shall be settled by negotiation. In the event of failure to reach an agreement, disputes shall be settled by the procedure established by the legislation of the Republic of Lithuania.
